Topsail Island is 26 miles long and split between three towns: Topsail Beach at the south end, Surf City in the middle, and North Topsail Beach to the north. Each one writes its own beach rules, and they differ more than most visitors expect. Gear comes off the sand at a different hour in each town, the alcohol rules differ, and North Topsail Beach is the only place left to drive on the beach.
The rules below come from each town’s code and website as of October 2026, and the sources are at the end. Rules change by ordinance, sometimes mid-season, so treat the signs posted at each beach access as the final word.

When does your beach gear have to come off the sand?
Every evening, in every town. Tents, canopies, cabanas, umbrellas, chairs and toys all count as beach equipment, and none of the three towns limits their size. What the towns care about is that you take them home.
- Surf City: anything left on the beach between sunset and sunrise is classified as abandoned and removed by the town, with a $50 fine for each day. The town amended this rule on September 1, 2026; an older town page still says 10 p.m., but the code now says sunset.
- Topsail Beach: gear left unattended between 7 p.m. and 7 a.m. is removed and disposed of, with a $100 fine. Non-motorized sailboats and catamarans can stay on the sand overnight from May 15 to September 15.
- North Topsail Beach: gear left between 9 p.m. and 7 a.m. is treated as litter and removed, with a $50 fine.
In all three towns, set up at least 25 feet from any beach access or emergency access so rescue vehicles can get through, and at least 20 feet from any marked sea turtle nest. Topsail Beach adds 20 feet from dune plants, and both Topsail Beach and North Topsail Beach ban anything on the ocean side of a nest.
Can you dig holes on the beach?
Yes, with one rule that is the same island-wide: a hole deeper than 12 inches needs someone watching it, and it has to be filled back to level before you leave. North Topsail Beach also wants holes filled 30 minutes before sunset. The reason is practical: people turn ankles in them after dark, and nesting sea turtles and hatchlings get trapped in them. Knock down the sandcastle on your way out too.
Can you drink on the beach at Topsail?
It depends on the town, and on where in the town.
- Surf City: liquor and unfortified wine are banned anywhere on the beach. Open beer is banned on the stretch between the public accesses at 300 North Shore Drive and 200 South Shore Drive, around the pier, and that zone is signed. Outside it, beer is not prohibited by the beach ordinance.
- North Topsail Beach: beer and unfortified wine, including wine coolers, are allowed for anyone of legal age. Hard liquor and fortified wine require a state permit, and alcohol is banned at the Town Park and the Onslow County beach accesses.
- Topsail Beach: the town code bans liquor on town property. It does not clearly say whether beer and wine are allowed on the strand, and the newer guidance we found is secondhand. Call Town Hall at 910-328-5841 before you pack the cooler.
Glass is banned on the beach in all three towns, so pour drinks into cans, plastic or an insulated tumbler at the house. Surf City also bans Styrofoam cups, plates and containers on the beach (coolers are fine).
Are fires, grills and fireworks allowed?
Open fires are banned on the beach in every town, so there are no beach bonfires anywhere on Topsail. Grills are where the towns differ: Surf City allows portable gas grills with 350 square inches or less of cooking surface and nothing charcoal or wood-fired, North Topsail Beach allows small gas grills only, and Topsail Beach allows charcoal grills.
Fireworks fall under state law. North Carolina allows only the small ground-based items, such as sparklers, snakes, smoke devices and party poppers. Anything that flies or explodes needs a permit, and Surf City bans fireworks in its parks, beach accesses and access parking lots. Sky lanterns are banned too.
What are the dog rules on Topsail beaches?
Dogs are welcome on the beach in all three towns, with different leash rules.
- Surf City: leashed year-round, on a leash no longer than 20 feet and in your hand. Voice control does not count.
- North Topsail Beach: leashed year-round on a leash up to 25 feet (retractable leashes are fine), with a $100 fine for a loose dog or for leaving waste behind.
- Topsail Beach: leashed (20 feet or less) from May 15 through September 30. The rest of the year a dog may be under voice control, but only if it obeys every time. Since a September 2026 town notice, dogs must be leashed at all times at the south end, in the Topsail Nature Preserve.
Pick up after your dog everywhere. For vets, dog-friendly patios and the rest, see our guide to bringing your dog to Topsail Island.
Can you drive on the beach?
Only in one place. North Topsail Beach runs a 4x4 Permissible Driving Area at Onslow County Beach Access #3, off River Road at the north end of the island, toward New River Inlet. You need a factory four-wheel-drive vehicle and a pass bought in the SurfCAST by Otto app: $25 a day or $100 a week, with a $50 fine if you drive without one. The gate is open 6 a.m. to 7 p.m. from April through September and 7 a.m. to 5 p.m. from October through March. Keep to the posted speed, stay out of the posted area at the inlet, and give pedestrians the right of way. ATVs, motorcycles and go-carts are not allowed.
Topsail Beach stopped issuing beach driving permits in 2026, and Surf City allows only emergency and town vehicles on the sand.
What gets visitors fined most often?
- Walking on the dunes. Use the marked crossovers and walkovers. Surf City’s penalty starts at $100 and the violation is also a misdemeanor; North Topsail Beach lists a $500 fine. Pulling up sea oats is a state misdemeanor.
- Surfing too close to a pier. Surf City bans surfing, body boarding and rafting within 300 feet of either side of a fishing pier, with fines of $100, $200, then $300. Topsail Beach sets the line at 500 feet and includes paddleboards and kayaks. In both towns, surfboards must be leashed.
- Smoking near the pier. Surf City bans smoking and vaping on the beach in the central zone around the pier, on every public beach access, and within 20 feet of an access on the street side.
- Parking. See below. Each town enforces its lots, and Topsail Beach and North Topsail Beach ban on-street parking, so use the lots.
- Releasing balloons. Banned in Surf City and Topsail Beach.
- Swimming in the inlet. North Topsail Beach prohibits swimming or wading in New River Inlet, where the current is strong enough that the town calls it extreme.
How does beach parking work on Topsail Island?
- Surf City: paid March 1 to October 31, 9 a.m. to 6 p.m., by text or QR code through Pivot Parking, with hourly, daily, weekly and season options. Rates vary by lot and are posted at each one.
- Topsail Beach: paid daily March 1 to October 31. The oceanfront lots run 9 a.m. to 5 p.m. at $6 an hour (up to 4 hours) or $30 a day. The south end lot runs 6 a.m. to 9 p.m. at $7 an hour or $35 a day and closes overnight. Pay in the SurfCAST by Otto app or by QR code.
- North Topsail Beach: paid year-round, 9 a.m. to 5 p.m.: $5 an hour, $25 a day or $100 a week, also through SurfCAST by Otto. A ticket is $25 if paid the same day and $50 after that.
Onslow County runs its own beach accesses in North Topsail Beach; our guide to the best family beaches on Topsail Island covers them and the best Surf City accesses for kids. Posted rates at the lot are the final word.
Lifeguards, flags and sea turtles
Surf City Ocean Rescue answers calls all year and staffs up from Memorial Day to Labor Day, with a certified swimmer on standby from 9 a.m. to 7 p.m. and patrols by ATV rather than fixed stands. Warning flags fly at the central Surf City accesses, and the Surf City Fire Department posts a daily beach report on its Facebook page. North Topsail Beach has no lifeguards. Whatever town you are in, check the day’s rip current risk from the National Weather Service before you swim, and if you get caught in a rip, swim parallel to the shore until you are out of it.
Sea turtles nest on Topsail from about May through October. None of the town codes we checked sets a lights-out curfew, but North Topsail Beach and the turtle hospital ask for the same things: turn off beach-facing lights after dark, use a red light on the beach at night, stay well back from roped-off nests, and never touch a nest or hatchling (that one is federal law). The Karen Beasley Sea Turtle Rescue and Rehabilitation Center in Surf City is the place to learn why (tour details are in our rainy-day guide).
Staying in Surf City
Sound to Sea is in Surf City, so the Surf City rules are the ones you will live by: gear off the sand by sunset, dogs on a 20-foot leash, and no glass. The house has private beach access about 400 feet away, which means no paid lot and an easy walk to carry the tent home each evening. The neighborhood sound-side dock is about 300 feet the other way. It sleeps 11, and dogs are welcome. See the house or book direct.
